Terminals and radio equipment will be imported into the Congolese territory only after obtaining approval certificates. Information concerning the issuing of these certificates was given during a press conference conducted by the telecom regulator of Congo, the ARPCE.
As for October 1 st , importers of radio and terminal equipment will be compelled to obtain approval certificates for any import. The ARPCE intends to issue two certificates of technical compliance to importers. The first will be issued before the pieces of equipment are embarked and the second, when they have reached the country. The procedure has been defined in the n°2015-254 of 19 February. Technical import inspection is carried out at the land, air and sea ports of entry at national borders provided with a customs office. Control operations are undertaken at the place where the pieces of equipment are cleared and before the customs office authorizes their removal. If for technical reasons, the control cannot be carried out at the place where the pieces of equipment are cleared, it can be done at the storage depot of the importer. Under these conditions, a temporary authorization for removal is issued by customs services.
These new import procedures of terminals and radio equipment aim to ensure compliance of equipment with the required standards. Section 1 of chapter 2 of the
law n°9 of 25 November 2009 stipulates the sanctions that may be imposed on violators of the above-mentioned provision. Concerning administrative penalties, the fine is
between 10 and 20 million FCFA (article 173). As far as criminal sanctions are concerned, one to three months’ imprisonment and a fine of 500,000 to 1,000,000 are prescribed for anyone :

Installing, selling or retailing radio and terminal equipment or opening testing and
measurement laboratories for electronic communication equipment or working as an
installer, vendor or retailor of radio equipment without first obtaining an approval.

Continuing to work as an installer, vendor or retailor vio lating a decision of suspension or
withdrawal of the approval or after expiry of the validity period of the approval .
According the Director-General of the ARPCE, Yves Castanou the regulator wants to make sure that users have access to quality terminals and radio equipment.
We shall ensure that these pieces of equipment meet the international standardsâ€. In Accordance with
article 54 of the law n°9 dated on the 25 th November 2009, terminal equipment intended to be connected to a network that is open to the public and radio equipment are submitted to type approval of the regulatory agency. The regulator hopes it can count on the importers of the concerned equipment for the follow-up of the new approval procedure. Otherwise, the equipment
will simply not have access to the Congolese territory.
