The regulatory authority of the post and telecommunications (ARPT) was created under the Act L/2005/018/AN of September 8th 2005. The aim of the authority is to regulate the telecoms sector in the Republic of Guinea. This communiqué is compliant with the law N°/2015/018/AN of the 13th August 2015 on telecommunications and information technologies in the Republic of Guinea. Article 64 of this law states that “the aim of the type approval of terminal equipment and the installations of radio equipment is to oversee the general interest and to ensure the security of users and operators’ staff. Il helps protect ICT and telecommunications network and ensure that the pieces of equipment are compatible and can operate with public telecommunications /ICT networks and with terminal equipment that allows to have access to the same service.†The regulatory authority ensures operators’ compliance with the prescriptions resulting from laws and regulations that can be applied to them. It also monitors the obligations related to licences, authorizations and approvals they benefit from. Accordingly, it can impose sanctions. Article 144 states that the regulatory authority can pronounce sanctions against violators. Thus, all violations of the law to ensure type approval of ICT equipment are punished by a fine from 10,000,000 to 200,000,000 Guinean Francs.
